Below we inform you - the visitors of the art project Fischelant - how we process your data and what rights you are entitled to according to the data protection regulations.

3.Purposes of the processing of personal data and legal basis

a) Registration via Eventbrite: To organise timed visit slots for the Fischelant artwork, a visit is booked via the service provider Eventbrite, Inc.
This involves processing the first name, surname and email address of the person registering, as well as the date and time of the visit and the slot to which it belongs.
Purposes: Organisation and coordination of the visit, sending the confirmation email
Legal basis: The processing of your personal data is based on Art. 6 para. 1 lit. b) GDPR (fulfilment of a contract), Art. 6 para. 1 lit. f) GDPR (to safeguard our legitimate interests). Our legitimate interest lies in the safe and orderly execution.

b) On-site recording on the day of the visit: On the day of the visit, the names of all participants (up to 6 people per slot) are recorded by hand on a so-called "instruction sheet" for the artwork. This data collection is part of the artwork and is carried out for the documentary-performative involvement of the visitors.
Purpose: Art-related interaction as part of the Fischelant project
Legal basis: Your personal data is processed on the basis of Art. 6 para. 1 lit. f) GDPR (to protect our legitimate interests). Our legitimate interest lies in the artistic design and documentation in the context of the project.

4.Recipients of personal data

We may transfer your personal data to

  • internal departments (project team #3000Garagen/"Fischelant")
  • Legal advisors if this is necessary for compliance with applicable law or for the assertion, exercise or defence of legal claims
  • external service providers in their capacity as processors (e.g. Eventbride, Inc., data destruction) in order to process data with their products and services

5. transfer to a third country

The Eventbrite booking platform is provided by Eventbrite Inc, USA. Eventbrite is a processor and has published a data processing addendum at eventbrite.de/help/en/articles/429030/datenverarbeitungsnachtrag-fuer-veranstalter/. This sets out the provisions relating to the protection, confidentiality and security of personal data in connection with the services that Eventbrite provides to us under the agreement.
Eventbrite is certified under the EU-US Data Privacy Framework (DPF). The DPF is an agreement between the European Union and the USA, which is intended to ensure compliance with European data protection standards for data processing in the USA. Every company certified under the DPF undertakes to comply with these data protection standards.

6 Storage period of personal data

The paper forms (instructions for use) will be stored securely until the end of October 2025 and then destroyed in accordance with data protection regulations.
The data processed by Eventbrite is subject to their retention regulations. We have no direct influence on this and refer you to Eventbrite's privacy policy: eventbrite.de/help/en/articles/460838/datenschutzrichtlinie-von-eventbrite/

7.Your rights

According to Art. 15 ff. GDPR, you have the right to information, rectification, erasure, restriction of processing or objection to the processing of your personal data as well as the right to data portability.
You also have the right to lodge a complaint with the competent data supervisory authority in accordance with Art. 77 GDPR.
To exercise your rights, please contact the controller named under 1. or the data protection officer listed under 2. in writing, if possible.

8. Obligation to provide personal data

It is necessary to provide your name and email address when booking in order to organise your visit. The entry of names on site is an integral part of the artistic concept and is necessary for participation, but cannot be verified. It is technically possible to enter fantasy names, but this contradicts the purpose of the project.

9.Automated decision-making

Automated decision-making does not take place.
